SAN DIEGO — The sentencing of an ex-Compton school board official who was convicted of a sex crime on a man was delayed Monday until April 18 because the probation department wants a psychiatric evaluation as part of their sentencing report to the judge.
Skyy de Anthony Fisher, 32, was found guilty Jan. 28 of oral copulation on a sleeping man in his San Diego hotel room in a 2014 incident. A jury deliberated only 45 minutes before finding him guilty in a three day trial.
Usually it is the defense that requests a sentencing delay, but this time it was the probation department as they must write a report to San Diego Superior Court Judge Runston Maino as to whether he should get probation or state prison.
The 25-year-old victim, who was referred to as Steve in court, testified he woke up April 4, 2014, and found Fisher orally copulating him. Steve testified Fisher quickly returned to his bed and denied the act.
Steve called 911, and agreed to undergo a sexual assault exam. Fisher’s DNA from salvia was confirmed and was evidence at trial.
Fisher remains in the George Bailey Detention Facility without bail. He had been free on $100,000 bond, but Maino remanded him into jail after the verdict.
Fisher could receive a maximum sentence of eight years in prison, according to Deputy District Attorney Lisa Fox. He could also receive probation with a one year jail term.
Fisher, a Democrat, was the youngest man at age 28 to be elected to the Compton Unified Board of Education in 2011, but was defeated for re-election Nov. 3, 2015 while this trial was pending. Fisher received only 4.4 percent of the vote.
Though Fisher didn’t testify, his words were heard in a 35-minute call made by Steve at a San Diego police station that was tape recorded. Fisher repeatedly denied the oral sex, but apologized to Steve and said he was drunk at the time.
