A fifth suspect has been apprehended in the gang-rape of a fifteen-year-old Kentucky male that has stunned the local community of Hopkinsville, a bedroom community in Christian County, 26 miles north of Clarksville, Tenn.
According to the LeafChronicle.com, Sam Miller, 18, was detained in Louisville and transferred back to Christian County without incident. He is being charged with sodomy, first degree; promoting a minor in a sex performance; use of a minor in a sex performance; distribution of matter portraying a sexual performance by a minor. His bail has been set at $1,000,000 cash.
Four others have been arrested in connection with the rape that left the 15-year-old victim in critical condition after he was brought to the Gateway Medical Center in Clarksdale. Two, Tyler Riess Perry, 19, Dayton Ross Jones, 20, both from Hopkinsville, will be tried as adults and face charges ranging from the use of a minor in a sexual performance to first-degree sodomy to tampering with evidence. Two others, both 17 of Hopkinsville, face lesser chargers including possession of a performance/viewing matter which includes a minor. The gang-rape was videotaped and shared virally among others.
Jones, who plays golf for Arkansas State University, has been dismissed during the ongoing investigation. Officials at the school do not expect Jones to return as the video clearly puts him at the scene of the crime.
Kentucky law distinguishes first-degree sodomy from first-degree rape. In sodomy cases, unlike rape, the criminal system there classifies sexual intercourse separately from deviate sexual intercourse, implying homosexual rape is somehow different than heterosexual rape. The punishment for both crimes, which are Class B Felonies, is 10-20 years. It is uncertain what will happen to the two 17-year-olds. Much will depend on how the county prosecutors decide to pursue the case.
The victim is currently in serious but stable condition.
