Government required to spell out stance on gay military service

Just days after ordering an immediate end to the “Don’t, Ask, Don’t Tell” policy, the U.S. Circuit Court of Appeals issued a written order requiring the Obama administration to clarify its’ legal position on the ban against openly gay service.

According to Reuters, the administration failed to specify whether it intended to seek further review of military gay ban following last week’s order, which prompted the 9th Circuit Court to take additional action.

The order issued Monday requires the Obama administration to inform the Court of its’ intent to either accept the repeal of DADT or to defend the controversial policy.

In addition, the Government and Log Cabin Republicans are ordered to present their arguments to determine whether the case against the DADT repeal should be dismissed immediately or after the repeal has officially taken affect.

The Pentagon is currently in the process of certifying that the armed forces are prepared for the new policy allowing openly gay service, which will enter force 60 days after President Obama gives his stamp of approval.
