A 21-year-old tutor who pleaded guilty to having sex with a 16-year-old male student will be sentenced Jan. 3, a judge set on Tuesday.
Attorney Greg Turner, who represents Alejandro Rodriguez, turned in a report Tuesday shortly before Rodriguez was to be sentenced.
Chula Vista Superior Court Judge Garry Haehnle said he wanted to read it, but didn’t have time before the sentencing calendar, so he reset the sentencing.
Rodriguez worked for an agency contracted with the Sweetwater Union High School District. Rodriguez was one of three people who pleaded guilty to having sex with students under 18 at Mar Vista High School in Imperial Beach.
Deputy District Attorney Carolyn Matzger said Rodriguez faces up to three years in county jail, but not prison. She said her office won’t seek to require Rodriguez to register as a sex offender, but it is up to Haehnle to decide registration.
Rodriguez will likely get probation. He was the first of three arrested March 9 and was the only one to have a preliminary hearing in which the victim testified. Rodriguez remains free on bond.
Also on Tuesday, Haehnle delayed sentencing for Edward Aaron Mendoza, 27, a former football coach who pleaded guilty to committing three counts of lewd acts with a 9th grade girl. He’ll be sentenced Nov. 9, and remains in jail without bail.
Martin Gallegos, 48, a former substitute teacher and an ROTC instructor, was sentenced Sept. 23 to one year in jail for having unlawful sexual intercourse with a 12th-grade female. His expected release date is March 23, 2017.
