Another same sex marriage ban has fallen. The federal court has ruled the South Carolina marriage ban unconstitutional citing the rights of equal protection and dues process in the Fourteenth Amendment of the constitution. The decision is based upon the precedent set forth in the US Fourth Circuit Court of Appeals decision to strike down a marriage ban in Virginia. South Carolina is part of the same judicial circuit as Virginia.
With the recent ruling in the Sixth Circuit Court of Appeals upholding a same sex marriage ban, the ultimate decision will be made by the US Supreme Court. Marriages are set to begin in South Carolina on November 20, 2014.
