The 9th Circuit Court of Appeals will make an official ruling on the constitutionality of Proposition 8 by Tuesday at 10 am the court announced Monday.
The three-judge panel heard arguments more than a year ago but has not made an official ruling on whether or not the same-sex marriage ban violates the rights of gays and lesbians. The appeals court sought guidance from the California Supreme Court on whether proponents of Proposition 8 had legal authority to challenge a lower court ruling prior to making their official determination due Tuesday.
The decision will likely head to the U.S. Supreme Court as both supporters and opponents of Proposition 8 have said they would appeal the decision to a higher court.
On Friday, Feb. 3, the appeals court made a decision to overturn a prior ruling that would have allowed videotapes covering the historical Perry v. Brown trial to be viewed publicly.
